Mutual Recognition and Mutual Trust in EU Immigration Law: The Right to Effective Legal Protection and the Role of Administrative Courts

Samenvatting

The cooperation between Member States in the European Union (EU) is based on principles of mutual recognition and mutual trust. Based on these principles, national authorities are supposed to take into account or even apply decisions or laws of other Member States, trusting the quality and lawfulness of these foreign legal systems. For administrative courts, there is a tension between the duty to apply the EU principles of mutual recognition and mutual trust on the one hand, and their task in offering effective legal protection to the individual, on the other. This tension seems to be enhanced by the traditional restricted role of administrative courts when reviewing the decision-making of the national authorities.

This research aims to understand the impact of EU instruments based on mutual trust and recognition for the right to effective legal protection in ?cross border? immigration law procedures. Where current research addresses in particular the role of the judiciary with regard to mutual recognition and mutual trust in European criminal law, a normative and empirical investigation into the role of administrative courts in immigration law is lacking.

A comparative law method will be used to explore the existing problems encountered by administrative courts in this field. To understand both the political as legal meaning of ?mutual recognition? and ?mutual trust? a comparison will be made of different instruments of EU immigration law involving mutual recognition of foreign decisions or laws. Secondly, a comparison will be made of the case-law of three selected EU States. The findings of this research will be used to understand the factors and mechanisms influencing the approach of national courts and, if necessary, to develop instruments to safeguard the right to effective legal protection.
